Draft EIR Scheduled to be Released Tomorrow

The long-awaited and delay-plagued draft EIR for the Intermodal Station project is set to be released to the public on Wednesday. Or so it seems. (I’ll post a link when it goes live.)

The release of the document clears a significant hurdle for the project. The remaining hurdle is the land transfer between the developer/landowner (AndersonPacific) and the City.

Without the transfer, and corresponding developer agreement (DOPA), the station quite literally cannot commence construction, certified EIR or not. The City has reportedly threatened the use of eminent domain, but such a proceeding would delay the project even further by years, not months. (The City also doesn’t have a positive track record exercising eminent domain.)

UPDATE — The City has released the draft.
